Learned A.G.P. places communication dated 26.2.2019 whereby, it is communicated to the office of the Government Pleader that there is no proposal to detain the petitioner under the PASA Act.

The said communication is ordered to be taken on record. Under the circumstances, learned advocate for the petitioner seeks permission to withdraw the present petition at this stage.

Permission, as sought for, is granted. The petition stands disposed of as withdrawn.

It is clarified that the detaining authority shall not detain the petitioner under the PASA Act on account of the offence registered vide C.R.No.I-104 of 2018, C.R. No.I-84 of 2018 and C.R. No.I-85 of 2018 with Adalaj police station, C.R. No.I-80 of 2018 and C.R. No.I-81 of 2018 with Infocity police station. However, the competent authority is at liberty to initiate proceedings under the PASA Act against the petitioner in respect of the other offences, if any, registered and incriminating materials found and made available after disposal of the present petition.
