Heard learned advocate Mr.Girish Prajapati for learned advocate Mr.J.S. Sadhwani for the petitioner.

By relying upon Circular dated 06th December, 2014 issued by the Industries and Mines Department, State of Gujarat, which inter alia provides that Collector and the competent authority is required to dispose of the proceedings initiated before them in respect of grant of quarry lease, particularly when they are acting on remand upon a direction issued by the revisional authority, such proceedings by the Collector shall have to be disposed of within 45 days, it is submitted in this petition that in respect of petitioner's case also, the said time limit as per the said Circular is required to be observed by the Collector-the first respondent herein.

It appears that by order dated 24th August, 2015 the revisional authority has directed the Collector, Gandhinagar to decide the application of the petitioner for grant of quarry lease in the area of riverbed out of 01-86-00 Hectors at Survey No.942 at Village Anodiya, Taluka Mansa, District Gandhinagar. Upon remand of the matter, the case is pending before the Collector. In that context, the petitioner wants that Collector should observe the provision of the Circular.

4. Learned advocate relies on order dated 13th April, 2016 passed in Special Civil Application No.6046 of 2016. This petition is disposed of in light of the aforesaid facts and circumstances that the Collector shall adhere to the time limit provided for in the Circular dated 06th December, 2014 as far as possible and shall decide the proceedings expeditiously.

5. The petition stands disposed of in the aforesaid terms. Petitioner is permitted to produce copy of this order before the Collector.
