1. By this writ application under Article 226 of the Constitution of India, the applicants have prayed for the following reliefs:
"12(B) Be pleased to direct respondent authorities to grant benefit of higher pay scale on completion of their 9-18-27 years of services along with consequential benefits after placing petitioner on temporary establishment and be pleased to direct the respondent authorities to pay arrears for the same in the interest of justice.
(C) YOUR LORDSHIPS MAY PLEASED TO allow the petitioner by issuing a writ of mandamus or any other appropriate writ, direction and/or order in the nature of mandamus directing the respondents authorities to grant the benefits of Work Charge Establishment and Temporal Establishment as well as Work Charge Work Assistant on completion of requisite years of service in their respective cadres in favour of the petitioners forthwith with deemed date.
(D) Be pleased to direct respondent's authorities to consider the cases of the petitioners on the basis of the order passed by this Hon'ble Court in Special Page 1 of 2 HC-NIC Page 1 of 2 Created On Sun May 08 01:59:11 IST 2016 C/SCA/7586/2016 ORDER Civil Application No.10829 of 2003 and allied matters decided on 04.02.2016 and dispose off the same in line with the order passed in the above referred matters.
(E) Be pleased to direct the respondent authorities to consider the service rendered by the petitioners as a daily rated employee as a continuous service for grant of future benefits like pension etc...
(F) Pending hearing and final disposal of the present petition, Your Lordships may be pleased to direct the respondents authorities to release the benefits the benefits of higher promotional post of Work Charge Establishment and Temporary Establishment in favour of the petitioner subject to the outcome of the petition."
2 The respondents are directed to look into the matter and see to it that an appropriate decision is taken in accordance with law within a period of eight weeks from today, keeping in mind the judgment and order pronounced by this Court dated 4th February, 2016 in the Special Civil Application No.10829 of 2003 and allied matters.
3 With the above, the writ application is disposed of. Direct service is permitted.
