Heard Mr.Jaydeep H.Sindhi, learned advocate for the applicant. He has submitted that except the applicant named in the FIR, there is no other material appearing against him. He has further submitted that the beef, which is found from an open place, the applicant has no nexus with it. Therefore, he has submitted that there is no prima-facie case made out against the applicant and therefore, he requests for entertaining the application.

As against that, Mr.Ronak Raval, learned APP is unable to show, any material against the applicant except the statement of co-accused though offence is registered in April, 2019, as on today.

Hence, Rule. Mr.Roank Raval, learned APP waives service of rule on behalf of Respondent No.1-State, as also the first informant- Respondent No.2, who is present before the Court, who is police officer.

registered under C.R.No.II- 119 of 2019 registered with Chikhli Police Station, District: Navsari, is hereby stayed qua the applicant alone. The Investigating Authority is free to investigate into an offence against any other accused, if their involvement is found by them. It is made clear that there is no stay granted against the investigation except the present applicant.

Direct service is permitted.
