KARIA Date : 22/02/2019 IA ORDER By this application, the applicant has prayed for condonation of 66 days delay caused in preferring the First Appeal.

Heard learned advocate for the applicants. It was submitted by learned advocate for the applicant that after getting certified copy of the impugned judgment and award, the Panel Advocate of the trial Court sent the said copy with legal opinion to the Divisional Officer, Himmatnagar on 30.05.2017 and Divisional Office received the same on 03.06.2017. Thereafter, the said office sent the papers to the legal advisor of the ST Corporation, Ahmedabad on Page 1 of 2 C/FA/3302/2017 IA ORDER 14.06.2017 and the legal advisor of the GSRTC sent back the papers to the Divisional Office, Himmatnagar on 30.08.2017 taking view to file an appeal and thereafter, the Divisional Office, Himmatnagar approached the panel advocate of the GSRTC in the High Court. Thus, the delay has been caused due to administrative process and learned advocate for the applicant requested to condone the delay caused in filing the present appeal.

On the otherside, learned advocate for the respondents has strongly objected the submissions made by learned advocate for the appellant and requested to dismiss the present application.

Having heard learned advocates appearing for the respective parties and having considered the averments made in this application, I am convinced that sufficient cause has been made out for condonation of delay of 190 days in filing First Appeal. Delay is hereby condoned.

Civil Application stands disposed of accordingly. Rule is made absolute.
