1. The petitioner by this petition seeks to direct the Investigating Agency to investigate the first information report being I­C.R. No.33 of 2015 registered with Madhavpura Police Station, Ahmedabad, and now pending with Special Operation Group (Cell), Juhapura Police Station, in a fair and impartial manner. It is submitted that looking to the seriousness of the matter, now the investigation has been handed over to the CID (Crime). Shri Bhadrish Raju, learned counsel appearing for the petitioner, has urged that Page 1 of 2 HC-NIC Page 1 of 2 Created On Fri May 06 02:50:15 IST 2016 R/SCR.A/2811/2016 ORDER earlier the petitioner had already approached this Court seeking transfer of investigation by way of Special Criminal Application No.2161 of 2015, wherein this Court has issued notice vide order dated April 27, 2015. The said petition, according to him, now would not survive as the investigation has already been transferred to the Special Operation Group (Cell), Juhapura Police Station.

2. In view of aforesaid, let the concerned Investigating Officer instruct the learned Additional Public Prosecutor or shall remain personally present before this Court on the next date of hearing.

Let the matter appear on May 06, 2016. Let Special Criminal Application No.2161 of 2015 be tagged with the present petition.
