Heard learned counsel for the petitioners and learned Standing counsel for the State-respondents.
The instant writ petition has been filed seeking amongst other the following relief -
"A. issue a writ, order or direction in the nature of mandamus directing the respondent no.2 to decide Revision no.1636 of 2018 Firdaush Bano and others Versus Chandrika and others under Section 219 of the U.P.L.R. Act, expeditiously as possible as within short stipulated period which is pending in the Court of Sub-Divisional Magistrate, Jakhania District Ghazipur."
The revision aforesaid sought to be expedited has been filed in the year 2018 and arises out of proceedings under Section 34 of the U.P. Land Revenue Act for mutation.
Perusal of the order sheet appended along with the writ petition reveals that on most of the date fixed before the revisional Court, the matter had been adjourned because the lawyers were on strike.
It is therefore, clear that there is no fault on the part of the Court concerned, in case, the matter has remained pending.
Under the circumstances, the writ petition is disposed of with the observation that the Court concerned, respondent no.2, Additional Commissioner(II) Varanasi Division, Varanasi, may endeavour to decide the revision expeditiously.
It is clarified that the Additional Commissioner (II) Varanasi Division, Varanasi need not comply with the directions contained in this order, in case, the lawyers continue remain to on strike.
