Regulation No.113 of the Service Regulations of the erstwhile Gujarat Electricity Board (hereinafter referred to as 'the Regulations'), according to the learned counsel Shri A.K. Clerk appearing for the petitioner, has been held unjust, arbitrary and violative of the principles of natural justice in Letters Patent Appeal No.1974 of 2004 in Special Civil Application No.9492 of 1996 and allied matters. It is submitted by the learned counsel for the petitioner that the Gujarat Electricity Board (hereinafter referred to as 'the GEB') had challenged Page 1 of 2 C/SCA/5457/2015 ORDER the said order passed in Letters Patent Appeal before the Apex Court by way of Special Leave Petition No.37677 of 2013 and the Apex Court has dismissed the said Special Leave Petition in limine on December 13, 2013. It is his say that the petitioner, who served as a Driver with the GEB from February 05, 1980, has been deprived of his salary and allowances and all monetary benefits of his services on account of the said Regulation 113.
