1.0 More the Court goes on hearing the matters, more the Court is convinced that the sayings are on the basis of the wisdom of ages. It is said that the facts are more stranger than fiction. Here is another such case. The suit is filed in the year 1998, on 19th June 1998, the Written Statement is filed on 21st July 1998, the Issues were framed on 4th January 2003 and the plaintiff submitted his Chief Examination on affidavit on 6th November 2003. The matter was for his Cross-examination on board on 15th November 2005. Before it could be undertaken, the case was transferred to another Court on 23rd January 2006. Since then, the matter was pending at the stage of cross-examination till 22nd July 2008. Then the plaintiff realized that documents of some other property are annexed in the suit and that the suit is pertaining to some other property. Therefore, an application exh. 69 was filed on 19th December 2009 seeking permission to produce the documents pertaining to the property qua which the suit was filed. That application was dismissed by the learned Principal Civil Judge, Kadi by order dated 30th January 2010 and that order is under challenge before this Court.
2.0 The learned Judge dealt with the contents of the application and the submissions made by the learned advocate for the plaintiff. The Court finds no reason to interfere with the order passed by the learned Judge. Hence, this petition is dismissed.
