Dineshbhai S/O Virabhai ... vs State Of Gujarat

1. This application is filed by the original accused for quashing and setting aside the FIR being C.R.-I No.29 of 2019 registered with Shahibaugh Police Station, District : Ahmedabad for the offence punishable under Sections 395, 294(b) and 337 of the Indian Penal Code and Section 135 of the Gujarat Police Act. It is with the consent of the complainant.

2. Rule. Mr.Dabhi, learned Additional Public Prosecutor and Mr.Pathan, learned advocate waive service of notice of Rule on behalf of the respective parties.

3. Learned advocates for the applicants and the original complainant have jointly submitted that the parties have settled the dispute out of the Court. Attention of the Court is also invited to the Affidavit of the complainant dated 30.07.2020, in this regard. 4. It is noted that, in the complaint, no offence to public at large is made out. It is a private dispute which the parties have settled.

5. Considering the totality, the following order is passed.

Shahibaugh Police Station, District : Ahmedabad is quashed and all the proceedings, based thereon, connected therewith and consequential thereto are quashed and set aside.

5.3 Rule is made absolute in above terms.
