1. According to the petitioner the cheque which is alleged to have been dishonoured was lost. The petitioner was intimated of the same, however, there is no criminal complaint filed. Reliance is placed on the decision of this Court rendered in case of NIRAV BIPINBHAI PATEL vs STATE OF GUJARAT & ANR, reported in 2016 JX (Guj) 422 where of course along with giving intimation to the Bank, the police complaint also was filed for lost cheques.

returnable on MARCH 15, 2019. The formal service of notice is waived by the learned Additional Public Prosecutor for and on behalf of the respondent­State.
3. Pendency of this petition shall not preclude the Trial Court to proceed with the matter.
