Learned APP Mr. HL Jani had made a statement on the last occasion that the evidence of the I.O. is to be recorded. Today, learned APP Mr. Pandya states that the evidence of the I.O. has been recorded and now the matter has been kept for recording the further statement under sec. 313 of Cr.P.C. and thereafter for hearing of the arguments.

In the circumstances, learned advocate Mr. Bhatt does not press the present application with a request that necessary direction may be given to dispose of the case expeditiously as the other co-accused have been released.

In the circumstances, the present application stands disposed of with a direction that Criminal Case No. 1370 of 2004 pending before the trial court shall be disposed of as expeditiously as possible, preferably within two months from the date of receipt of the order of this court. D.S. permitted.
