Mr.M.B.Rana, learned advocate for the petitioners states that the petitioners have made applications to the Municipal Corporation on 20.11.2019 and 07.12.2019 for permission to repair their premises which are located in the disturbed area. Mr.Rana, learned advocate for the petitioners submitted that in view of the decision of this Court rendered in Special Civil Application No.8464 of 2019 wherein this Court has quashed the order of the SSRD and the issue is concluded in favour of the original owner and as the present petitioners are the purchasers and therefore they would not be required to seek further permission under the Act. Keeping this decision in view and the communication of the State Government dated 29.11.2019, he will be satisfied if this court issues the direction to the respondent Ahmedabad Municipal Corporation to Page 1 of 2 Downloaded on : Tue Jan 07 20:51:46 IST 2020 C/SCA/427/2019 ORDER consider his applications dated 20.11.2019 and 07.12.2019 in light of decision of this Court rendered in Special Civil Application No.8464 of 2019 and the communication of the State Government dated 29.11.2019. Accordingly, this petition is disposed of with the direction to the respondent - Corporation to consider the applications of the petitioners dated 20.11.2019 and 07.12.2019 in light of the decision rendered by this Court in Special Civil Application No.8464 of 2019 dated 24.09.2019 and the communication of the State Government dated 29.11.2019 within a period of three weeks from the date of receipt of copy of this order.

In view of the order passed in the main matter, Civil Application does not survive and stands disposed of accordingly.

Direct service is permitted.
