The matter was called out twice, none has remained present for the respondent. This matter is of the year 2004. The main contention raised by learned counsel for the workman is that on account of so called disability incurred by the workman, straightway his services were terminated without affording him an alternative employment by way of recategorization.

The matter deserves to be disposed of hence in order to afford an opportunity to the other side, it is kept on 11.2.2010 for admission hearing with a specific observation that if none appears for respondent, the matter will be decided finally after hearing counsel for the petitioner on point of recategorization.
