Mr. K.M. Antani, learned AGP under instructions of Mr. Ghanshyamsinh, Head Constable, Buckle No. 9707, states that there is no order of detention as on date against the petitioner under PASA Act. In view of the said statement, learned advocate for the petitioner seeks permission to withdraw the present petition. Permission as prayed for is granted. This petition stands disposed of as having been withdrawn. The detaining authority is directed to apply its mind with regard to the nature of offences and likelihood of breach of public order, if any, before passing any order of detention against the petitioner. If as and when order of detention is passed, it will be open for the petitioner to challenge the same in accordance with law. Rule is discharged. Interim relief, if any, shall stand vacated.
