Heard Sri Raghubir Singh, learned counsel for the petitioner, and learned Standing Counsel for the State-respondent.
The petitioner, claims that he made an application for a copy of his answer-sheet, in the subject of mathematics, in the Intermediate Examination, 2019, issued by the respondent-Board. The only prayer, made by Sri Raghubir Singh, learned counsel for the petitioner, is that the representation of the petitioner, may be decided within a stipulated period of time.
No useful purpose will be served by keeping the writ petition pending.
The matter is remitted to the respondent no.1, Secretary, Board of High School and Intermediate Education, U.P., Allahabad.
A writ of mandamus is issued, commanding the respondent no. 1-Secretary, Board of High School and Intermediate Education, U.P., Allahabad, to decide the representation of the petitioner, for the copy of her answer-sheet, in the subject of mathematics, in the Intermediate Examination, 2019, issued by the respondent-Board, within a period of one month, from the date of, receipt of, a certified copy of this order, along with a fresh copy of the representation, in the prescribed format after deposit of requisite fee or proof of such deposit.
The respondent No.3-Institution is directed to cooperate with the respondent-Board in the enquiry.
It is clarified that this Court has not gone into the veracity of the assertions made in the writ petition nor the claim of the petitioner has been judged on merits. It is for the competent authority to do so after independent application of mind in accordance with law.
With the aforesaid directions, the writ petition is finally disposed off.
