Learned advocate refers to shown cause notice dated 8.2.2010 issued by the Collector, Surat in exercise of powers under Section 108(6) of Bombay Land Revenue Code and submits that the subject matter of the complaint is part of the above revenue proceedings. Besides, the allegations levelled in the complaint is the period prior to 28th October, 2000.

Considering the above, notice returnable on 7th July, 2010. Mr. U.A. Trivedi, learned APP, waives service of notice on behalf of respondent No.1.

Ad-interim relief in terms of para 5(b).
