(PER : HONOURABLE THE ACTING CHIEF JUSTICE MR. VIJAY MANOHAR SAHAI) We have heard learned advocate Mr. A.A. Zabuawala for the petitioner.

2. This petition in the nature of public interest litigation has been filed praying that environment is getting polluted and hot mix plant has been established on the plot due to which crop and health of the citizens of village are in danger. It is further creating noise pollution.

3. Under the National Green Tribunal Act, 2010, an alternative remedy has been provided to the petitioner. Therefore, this petition in the nature of public interest litigation is dismissed with a liberty to the petitioner to seek alternative remedy before Western Bench of National Green Tribunal.
