  • Milk and Milk Products Order, 1992

These earlier laws and orders were repealed upon the commencement of the FSS Act in 2006. However, it’s important to note that while the FSSAI (Food Safety and Standards Authority of India) was established in 2008, its effective functioning and enforcement of rules and key regulations began in 2011.

One significant shift brought about by the FSS Act was the move from a multi-level regulatory framework to a single line of control. The focus also shifted from strict regulatory measures to promoting self-compliance within the food industry. Ministry of FSSAI License

The FSSAI was formulated under the Food Safety and Standards Act, 2006. The Act was pushed to the Ministry of Health & Family Welfare from the Ministry of Food Processing Industries. This legislation is directly related to the governance and management of food safety in India. Various Acts like the Prevention of Food Adulteration Act,1954, Vegetable Oil Products (Control) Order, 1947, Fruit Products Order, 1955 and Meat Food Products Order, 1973 were replaced by this Act. The Food Safety and Standards Act, 2006 acts as the single convergent point for all matters pertaining to food safety.

The FSSAI monitors and supervises the food business in the country. The Food Safety Standard Authority of India (FSSAI) took a significant step in May 2023 by constituting a Scientific Committee to address emerging issues related to nutraceuticals and highly processed foods.

  • Exemption of small-scale food producers, retailers, and street vendors from FSSAI regulations, leading to a significant unorganized food sector with lower prices, making it a popular choice among the population.
  • Inadequate infrastructure, including a shortage of food testing laboratories. Only 87 laboratories are NABL accredited, while more than 1500 private labs exist in India.
  • Shortage of qualified personnel and functional food testing equipment in state and referral laboratories, resulting in insufficient testing of food samples.
  • A lack of licensing and enforcement officers in states, negatively impacting food safety measures.
  • FSSAI’s prescriptive nature has limited its effectiveness in ensuring safety, quality, and hygiene in the food industry.
  • Limited coverage of FSSAI regulations, with only 377 products listed, compared to over 10,000 standards in other countries, and infrequent updates to the list.

Techniques like the Internet of Things (IoT) have found application in food processing and production.

The FSSAI and ASCI (Advertising Standards Council of India) Ministry of FSSAI License have joined hands to curb deceitful claims and distorted advertisements given by the Food and Beverage industry thereby safeguarding the consumers. Further, the FSSAI has been the fulcrum in a few landmark case decisions like that of the Nestle India Limited’s Maggi case, wherein Maggi noodles were held unfit for consumption due to the presence of increased levels of lead and monosodium glutamate in it and FSSAI scheduled a ban for the product. The FSSAI, therefore, takes food safety and public safety as its top priority and strives to establish an adultery-free food zone.
