Criteria For Forming a Society Under The Law

To comply with the Real Estate (Regulation and Development) Act, 2016, Section (11) (4) (E) states that a venture’s promoter must assist in the formation of a company composed of venture allottees as defined by applicable legislation.

Society Registration Process:

The members of the Society must sign the memorandum and submit it to the Registrar, who will then register it.

The memorandum shall include the name of the Society and its goals. The management’s details must be provided in the application.

Choosing a Name

Union, State, Land Mortgage, Land Development, Cooperative, Gandhi Reserve Bank, or any other term which expresses or implies the endorsement, approval, or patronage of the Central or any state government, or any term which suggests the co-operation of the government of the state in which the Society is located.

The Society’s name shall not include the following: Emblems and names protected by the Emblems and Names Act, 1860, will not be added to the registry.

Consider These points:

  • The Society Act, 1860 says that if two names are chosen that are identical, the Authority reject them. This restriction should be followed when naming the Society.
  • In addition, the name should not offend either the state government or the Indian government.
  • The Emblem and Names Act (Prevention of Improper Use) of 1950 must be followed when naming a company or organization.
  • Words and phrases critical of the government or the community are forbidden.
