Does Copyright Encourage Creativity? Let’s Discuss

Creativity being the keystone to a society’s economic and social progress, cannot be ignored.

Thus by ensuring safeguards to the performing rights of the authors or creators, copyrights serve as a kind of reward for creativity, thus encouraging people to do more. Copyrights protect the efforts, and hard work of the authors, designers, creators, dramatists, musicians, architects, producers of cinematographic films and sound recordings, as well as creators of computer software. By doing so, an atmosphere conducive to creativity is induced, which motivates others to create more.

How Does Copyright Help You?

Copyright ensures that individuals cannot use someone else’s work without permission. If a person uses another’s work without authorization, the copyright owner has the right to claim damages, file a lawsuit, and take legal action. On the other hand, a copyright owner has several privileges and can:

  1. Reproduce the work and create multiple copies of the original content.
  2. Distribute copies of the work for a fee or any other consideration.
  3. Display the work, for instance, in a museum, art gallery, or during a roadshow.
  4. Transfer their copyright by entering into a contract with another person.

These rights granted to the copyright owner protect their creative works and enable them to control and benefit from the use of their creations.

Advantages of Copyright Registration

Below are some advantages of registering for “copyright protection” in addition to the exclusive use or ownership granted by law to the creators of the work.

  1. Prima facie evidence: Copyright registration under Section 48 of the Act provides preliminary validity to the work, allowing owners to obtain a preliminary injunction against copyright infringers. It serves as evidence of ownership for the real owner.
  2. Global and unauthorized use protection: As per the Berne Convention, copyright in one contracting country extends similar privileges to the owner in another contracting country. While registration may not be mandatory, it provides a convenient standing for the owner in any situation.
  3. Economic benefits: Copyrighted works allow owners to derive economic benefits by authorizing others to reproduce, distribute, communicate, or adapt the work, earning royalties from such activities.
  4. Tracking and date of publication: Registered copyright listings help owners track their works, and the date of publication is crucial in infringement cases. Copyright registration includes the publication date, making it easy to identify infringement cases.
  5. Licensing rights: Copyright owners can license their works to others. Registration allows anyone to verify the true owner, confirming the work belongs to the licensor, and plays a significant role in exploiting one’s own work.
  6. One-time registration: Copyright registration is a one-time process, eliminating the need for renewal. The long-term grant allows owners to exploit their works throughout their lives and becomes a matter of public record.
