Who Can File a Complaint?

The following people or entities can bring a claim before the consumer complaints court:

  • A person is a consumer if they meet the following criteria:
  • In exchange for anything of worth, the person has bought something or used a service.
  • They must have purchased the things for personal use instead of selling or making money.
  • Any organization formed only for the benefit of its members and not for profit under the Companies Act of 1956 or any other legislation
  • Both the federal and state governments
  • Customers who share a common interest

Suppose all of the following elements are met. In that case, a online shopping complaint can be submitted by the Consumer as im an ESOP Lifecycle, his legal successor or representative, or a volunteer consumer association.

They should meet any of the following conditions:

What can be the reasons for filing a Complaint?

Unethical trade practices

The ultimate purpose of any firm is to make the most money possible. However, unfair practices such as defrauding clients, misrepresenting prices, and other infractions persist in the marketplace. It is a broad word that includes incidents where municipal authorities could not put up a warning sign while the road was still being constructed. Unfair trade practices were also found to have been used by a private contractor who failed to cover a maintenance hole, resulting in an accident. Because of this, the customer is entitled to register a consumer court complaint if any unfair commercial conduct is involved in any transaction.

The falsification of food

A violation of the Indian Penal Code is committed when food is tampered with to lower quality and raise prices. Examples include mixing salt with sawdust or ghee with dalda. Unfair consumer practices encompass even the impurity of the medication. Consumption and life are both threatened by adulteration. Food adulteration is an issue that should always be brought to the public’s attention.

The quickest way to weigh and measure

Most of the time, a typical general store defrauds its customers by under weighting the things it sells. It will appear that the goods weigh 1 kg on the scale, but it weighs roughly 800 grams. These kinds of malpractices threaten consumers’ interests.

False and misleading data

Everything may be found online in today’s technologically advanced world. Buying items online has many drawbacks, one being that sellers will do their best to deceive customers by offering misleading information. As a result of the broad scope of the Consumer Protection Act, online scams are also covered.

Defaulting on commitments

To uphold a promise, a corporation must first make a promise of its own. Some guarantees sound lovely, but if they can’t keep up with the contract, it can lead to many complaints, distrust, and customers switching to competitors.

Dissatisfied customers

Untrained customer service personnel that do not know how to converse with consumers correctly keep them waiting for extended periods before they can handle difficulties, which is a sign of poor customer service. Representatives are occasionally unable to resolve specific concerns or provide straightforward answers. When customers cannot resolve their problems, customer complaints begin.

When Can a Consumer File A Consumer Complaint?

If all of the following elements are met, a complaint can be submitted by the Consumer, his legal successor or representative, or a volunteer consumer association in customer complaint court.

  • The service provider’s use of unethical or restricted business practice.
  • Defective goods, whether the complainant has purchased them or has agreed to do so in the future;
  • There is a deficiency in the services provided, whether they were hired, availed of, or agreed upon.
  • Overcharging for goods or services beyond the price set by law, the price indicated on the packaging of items, the price list published, or as otherwise negotiated between the parties;
  • Trade-in hazardous goods or services that represent harm to life and safety when used or availed, provided that the trader knows the dangers of the goods and services.
