Who Are the Members of RERA’s Conciliation Forums?

Usually, such a forum comprises members of RERA authorities, resident associations, developer’s associations, and a member from the respective industry or development authority. The members of the forums may change as per the region of dispute.

Why Is a Conciliation Forum Needed?

If there were no conciliation forums, the RERA authority would receive your complaints and offer a solution. Often such a complaint process results in delayed resolution.  As an aggrieved party, you can lodge a formal complaint with the authority, against any RERA-registered developer or real estate agent.   • The aggrieved party applies for the conciliation of the forum as per the procedure set up by the state. Usually, a person can reach out to the specific states’ website, where there are two options to choose from, conciliation through conciliation forums, or filming a formal complaint. 
  • If the user opts for conciliation forums, on the receipt of the initiation of conciliation, the authority approaches the other party and offers dispute settlement through conciliation forums. If the party agrees, the forum’s bench invites the aggrieved parties for a hearing. 
  • The aggrieved parties must appear along with their authorised representatives, for instance, for home buyers it could be the head of the resident’s association, or any other organisation, while for the promoter, it could be someone from the company.

  • If the forum fails to arrive at an amicable solution, the bench may refer or register the case with the RERA authority. 
  • If no settlement can be reached, the complainant is free to reach out to settle the dispute through the RERA authority or any other court. 
  • Once both parties arrive at a settlement, a consent agreement is established between the parties. This consent agreement marks the closure of the complaint. 
  • If once after signing the consent agreement, any of the parties neglect or fail to abide by the agreed terms, this shall be treated as a breach of the respective state’s RERA order. This breach would be taken into account by any of the authorities while they pass the judgements.
