What Are the Different Consumer Forums?

The Helpline, consumerhelpline.gov.in, is an online resource center where consumers can lodge their complaints and grievances. This facility is available 24 hours a day, seven days a week.

The Department of Consumer Affairs has launched the helpline to create awareness, advise and redress consumer grievances and act as a central registry for lodging consumer grievances.

A customer can lodge a case in online consumer court against a service provider or a seller in case of faulty product delivery, improper service or harassment.

The government of India controls the judiciary hearings regarding consumer grievances. Below we will discuss the entire procedure for filing a complaint in consumer court.

Consumer complaints is the first level of appeal for consumer disputes. It deals with cases where the monetary transaction limit is between 20 to 50 lakhs.

The Act empowers the Government to pass rules to enforce the provisions of the Act. The State Government has been empowered to make rules to provide for the registration of complaints, the conduct of investigations, the making of rules relating to how the investigation is to be carried out and the making of rules to provide for the punishment of any person who is guilty of an offence under the Act. The Government is empowered to make rules to give effect to the provisions of the Act.

A consumer complaint steps is filed against an organization or a person when a consumer is dissatisfied with their service or product. This is done in the consumer’s interest, so that such a problem does not happen again. A complaint must be filed within a certain time frame. If this is not done, the complaint might be rejected. How to Appeal Against a Consumer Court Order?

The Consumer Complaints Act is an act passed in 2003 and replaced the Consumer Protection Act. It came into force on 1 April 2004. The Act provides for establishing a single national authority to receive, investigate and resolve complaints from consumers regarding any matter covered by the Act, including products, services and business practices.

A consumer can complain to a trader within two years from the date of the occurrence of the alleged act. The complaint must be in writing and delivered to the concerned company’s registered office. A copy must also be sent to the registrar of companies. The ecommerce complaint should be signed and stamped by the complainant and should specify the grounds on which the complaint is based.

If you are a consumer, you have the right to file a complaint against a company with the Consumer Protection Commission (CPC). The CPC is an independent government body set up to protect consumers. The CPC can help you resolve your complaint and help you get justice if your claim is not resolved. The CPC website has information on filing a complaint.

Conditions 

When you buy a product or service from someone else, you have the right to expect certain things from them. If you don’t get those things, you can complain.

A hazardous goods or service is anything that poses a threat to life and safety when used or availed. For example, if you were selling a can of poisonous gas, you would be required to register as a hazardous trader.

Complaint in a Consumer Court

A consumer is someone who purchases something, be it a product or service. And what qualifies as a consumer? Anyone who has bought something with money, whether it was a gift or a purchase.

A consumer is a person who purchases goods or services or engages in transactions and does so based on a bargain. A bargain is an agreement to supply goods or services at a price that is lower than the going market price.

One person can only sue a company at a time. For example, a consumer who has a dispute with a company can only sue that company. The company can’t sue the consumer for monetary damages.

Different Consumer Forums 

District Forum 

The complainant must file a complaint with the District Forum within 30 days of the alleged violation occurring. The complainant has 30 days to file a complaint with the District Forum. If the complainant fails to file a complaint with the District Forum within 30 days, the respondent shall have 30 days to file a counterclaim.

The District Forum is where the complainant can raise a complaint against the respondent. This complaint must be made within 90 days of the occurrence of the alleged incident. The complaint can be made in person or through an authorised agent. Four copies plus additional copies for each party are to be filed by the complainant. The Court Fee for valuation of suit up to 1 lakh is nil for those holding Antyodaya Anna Yojana cards: https://dfpd.gov.in/pds-aay.htm and in all other cases is 100.

For suits valued up to five lakhs, the court fee is 200; for suits valued up to 10 lakhs, the court fee is 400, and for those up to 20 lakhs, the court fee is 500. The Court Fee is to be submitted through a demand draft made out to the President, Consumer Disputes Redressal Forum, (name of) district.

State Consumer Forum 

The State Consumer Forum is a forum that deals with complaints against public servants. It is set up under the Consumer Protection Act 1986. The complainant may either file an original complaint provided it falls within the financial jurisdiction limit provided by law or file an appeal from the District Forum within 30 days of the order being passed.

The documents must bear the correct name and address of the parties. A certified copy of the order passed by the District Forum. Four copies are to be filed in Court, and additional copies are to be served on each Respondent. A copy of Interim orders passed by the District Forum or related Petitions to the case is to be attached and submitted along with an Affidavit.

The Appellant has requested an extension of 2 months for filing his appeal against the order of the learned Single Judge of the High Court.
