Court marriage is a legal process in which two people, who are not married yet, get married by the court. This can be done for many reasons like if one of them wants to marry someone else or they want to divorce their spouse. Various countries allow people to get married if their parent’s consent is not required. If you live in such a country, you may have heard of “court marriage”. Court marriage is when a couple gets married by a judge instead of getting married by a religious leader or a priest.

In India, certain registered marriage rules and regulations have been set up to protect children from being taken advantage of. One such rule is that when you apply for a passport or any other document, you must inform your parent name and address on the application form. Otherwise, you may face problems in the future.

Online Services

Court Marriage Registration

Lawyer’s Office

If you choose to visit a lawyer’s office, you must make an appointment. During the meeting, he will ask you questions about your relationship status. Additionally, he will give you a copy of the report, if you wish, forms that you need to complete. Then he will help you fill out the forms and send them back to his office. From there, he will take care of everything.

Steps to follow:

  • Ask your partner to sign an affidavit that they do not have any objection to you marrying another person. This affidavit should be signed before the magistrate and also before the registrar.
  • You must apply for a marriage license at the local registry office. Please complete the application form and submit it to the registrar’s office. It usually takes around 3-4 weeks to receive a reply.
  • Once you receive the reply from the registry office, you need to go to the court, where you will apply for permission to perform the ceremony. The fee for this is Rs.100/- per day.
  • After receiving permission from the court, you must take the permission slip along with the application form to the registry office.
  • Once you submit the application form at the registry office, the officer will inform you when the next date is scheduled for the hearing.
  • When the hearing date arrives, you must appear at the court along with all the documents mentioned above. The wedding will be performed as soon as possible if there are no objections.
  • You must file a petition in the family court after your wedding ceremony. You must prove that you have lived together continuously for more than two years.
  • Finally, the judge will give his final verdict and order after proving everything.
  • You both need to get a copy of the judgment and keep it safe.
  • After getting the judgment, you need to pay the court marriage registration fees the fine amounting to Rs.500/-.
  • After paying the fine, you must ensure you don’t break any law again.
