In view of the COVID-19 disruption, the FSSAI has granted additional time to Food Business Operators (FBOs) and distribution agencies to comply with Food Safety and Standards (Recovery and Distribution of Surplus Food) Regulations, 2019. In a Notification issued on 25th June, 2020, the timeline for compliance has been extended till 1st January, 2021.

 

If an individual is planning to start a food business or has already been running one, then he/she would need a food license. Irrespective of the mode of business like manufacturing, processing, storage, or sale of food, every FBO needs to have an FSSAI license. Further, FSSAI is a governing body that works towards the verification and validation of a food business in India. Once a company successfully registered with FSSAI and gets the license, they get the FSSAI license number

FSSAI License Number

As mentioned above, this number is given to an FBO that has successfully registered itself with the FSSAI. Moreover, it is a 14-digit number that is issued to FBOs. Now the question arises, what do these numbers indicate, the 14-digit FSSAI number is divided into five sections, and each section designates a certain meaning.

First Digit- The first digit of the license defined the status of registration

Second and third digit- This shows the state code where the business is running its operations

Fourth and fifth digit– It shows the year of manufacture of food

Sixth, seventh, and eights – It shows the quality of enrolling master

The last six digits ie, 9th, 10th, 11th, 12th, 13th, and 14th – it provides the license number

 FSSAI Guidelines

  1. Every food package must have the FSSAI license number
  2. The font color and shade of the 14-digit FSSAI number should be in contrast to the background of the food package. It means that the FSSAI number should be visible. The FBO owner has to ensure that the food package must have an FSSAI license number and the logo of the food business to be written in a way that the reader can easily identify the difference.
  3. Additionally, in case of import of food products, the FSSAI number, name and address of the shipper must be shared with the authorities
  4. The measure of printing on the food package in terms of font size must be based on the Food Safety and Standards (Packaging and Labelling) Regulations, 2011
  5. Moreover, the license number should be present on the addresses of the different unit markings of the product along with the quality of the delivery company
  6. FBO can use the logo and license number till the time it has not expired
  7. Therefore, you must renew the license on time

Types of FSSAI License

There are three types of FSSAI license, namely :

Basic Registration

This is given to FBOs that have an annual turnover of up to Rs. 12 lakh. It includes all the small-sized industries, storage units, retailers, distributors, etc.

State License

This is issued to the food units that have an annual turnover of more than Rs. 12 lakh and up to Rs. 20 crores. Additionally, these include medium-sized industries, retailers, distributors, marketers, etc.

Central License

This applies to companies that have a turnover of Rs. 20 core or more. It includes all the large manufacturers, importers, export-oriented units, operators at airports, seaports, etc. This license is issued by the central government.

  1. Who issues improvement notice?

Improvement notice is issued when the Food Business Operator fails to adhere to the food regulation set by the FSSAI Act, 2006. Moreover, this notice is issued by a designated officer or DO of the Food Safety Department.

2. What is the time duration for appealing to the State Commissioner of food safety?

FBO gets a tenure of 15 days from the date when the notice was issued, to appeal to the State Commissioner of Food Safety.

3. Is there a provision to modify the license, and is there any fee applicable to the same?

In case the FBO wants to make changes in the license, they need to make changes using Form C. To make this modification, they need to pay a fee, which is equivalent to the one-year license fee.
