Start-ups Now Eligible for Cheaper & Quicker Patents

The Indian government, in yet another move to encourage starting up, has announced that patent registrations will be expedited for all start-ups. The government fees will also be reduced, as start-ups will be allowed to apply for a patent as an ‘individual’, rather than a company. In effect, the government is offering a tatkal option at a lower price. While patents tend to take five to seven years to be granted in India, start-ups may expect their patents to be granted in 18 to 30 months. The order notifying the amended patent rules will soon be issued, as per Rajiv Aggarwal, joint secretary, Department of Industrial Policy & Promotion. To avail of the tatkal service, however, applicants would need to fit the definition of start-ups.
