What is the PSARA license?

PSARA license is a must requirement for opening any private security agency in India. These security agencies provide trained security guards and other security services to various organizations across the country. These security agencies are administered by an act called the Private Security Agencies Regulation Act.

What is the PSARA Act?

The full form of PSARA is Private Security Agencies, and PSARA Act provides for the regulation of private security agencies and any matters related to them. It was passed by both the houses of the Parliament and received the consent of the President on June 23rd, 2005.  The act came into force on March 15th, 2006. PSARA license is permitted to the private security agencies for their running and their operations by the controlling authorities of the respective states where the agencies are functioning.

 

Controlling Authority

The state should appoint an officer of the rank of Joint Secretary in the Home Department of the state or an equivalent officer as the controlling authority.

Eligibility Criteria for Obtaining PSARA License

Under the PSARA act, those agencies which require PSARA license should fulfil the following requirements:-

Any Private Limited company, limited liability partnership, one-person company, sole proprietorship, or partnership firm can be registered for PSARA license. Apart from this, the following conditions should be fulfilled:-

  • Any owner should not have been convicted for any offence regarding promotion, formation or management of the company.
  • No one should have been associated with any other firm banned by law.
  • No one should have been ever dismissed from his services on moral or other grounds.

Eligibility criteria for the appointment of the Director/Principal officer

  • The applicant should be an Indian resident.
  • He/ she should be financially stable (a copy of ITR has to be submitted)
  • The applicant should not have any criminal background.

Documents Required For PSARA Obtaining License

Given below is a checklist of the documents required for issuance of PSARA license:-

  • Certificate of incorporation
  • Signed Memorandum of Understanding
  • Address proof of the office
  • Employees state insurance registration
  • Provident fund registration
  • Identity cards of all employees
  • An affidavit obtained as per PSARA act
  • Logo for the private security agency
  • Uniform pattern
  • Copy of ITR
  • Character certificate of all employees

Charges for Applying For PSARA License

A prescribed fee of: accompanies the application for the PSARA license-

  • Rs. 5000 /- if the private security agency is operating in one district
  • Rs. 10,000/- if the agency is working in more than one and up to 5 districts
  • Rs. 20,000/- if the agency is working in the whole state

The validity of PSARA License

  • A PSARA license is valid for up to 5 years unless it is cancelled.
  • In states like Uttarakhand, Madhya Pradesh, and Chhattisgarh, the validity is only one year.

Renewal of PSARA License

  • The PSARA license can be renewed by applying the controlling authority, not less than 45 days before the expiry date of the permit along with the prescribed documents and the fee.
  • The controlling authority will pass an order for renewal of license within 30 days from the date of receipt of application.

Eligibility Criteria for Appointment of Security Guard

To become security personnel in any Private Security Agency, one should fulfil the following eligibility requirements:-

  • He should be a resident of India
  • Fulfils all conditions and physical standards.
  • He should be over the age of 18 years and under the age of 65 years.
  • He should have the prescribed security training successfully.
  • Must not have been convicted or dismissed on any grounds of moral misconduct.
  • Any member of Army, Navy, Air force or any Armed Force of Union or Police will be given special preference.

Cancellation of License

The license issued to any Private Security Agency can be cancelled by the controlling officer if:-

  • The permit has been obtained by presenting fake or incomplete documents.
  • The license holder/ holders have used false photographs.
  • The license holder does not comply with the provisions and rules of the PSARA act and has violated it with any one of them.
  • Any misuse of any information pertaining to the PSARA license.
  • The private security agency is using a fake name for functioning instead of the name used at the time of obtaining a license.
  • The license holder is not providing the services as per the PSARA act.
  • The private security agency is negligent towards their duties.
  • If the private security agency is involved in any kind of anti-national activity.
