In a recent judgement, the Bombay High Court cancelled the validity of a registration certificate issued for a marriage performed without rituals.  In this case, a resident from Thane earlier moved HC after the district family court had declared the marriage as invalid.


In June 2020, the Khadki court in Pune allowed a girl kept in the women’s remand home to go live with her husband as she was a major and could take that decision. The Court said that As per Article 21 of the Indian Constitution, a woman who had attained adulthood if free to stay in any place she likes without being constrained by her parents


A marriage certificate is the legal record of a marriage ceremony being performed by two individuals. You need to register your marriage first to receive the marriage certificate. It means the couple is married legally. Apply for Marriage registration in India can be done under the Hindu Marriage Act, 1955 or the Special Marriage Act, 1954, or the Parsi Marriage and Divorce Act, 1936. Registration of marriage is an important legal formality under the law and can easily be completed at the respective registrar’s office.

Purpose of the Marriage Registration

The need for a marriage certificate occurs in case you need to show that you are legally married to anyone, for reasons such as having a passport, visa, pension, insured number, changing the name of your maiden name, to get custody of the child, claim spouse’s property, etc.

Eligibility for applying of Marriage Registration

  • Most importantly, the age of eligibility is 21 for men and 18 for women. 
  • Moreover, solemnize marriages can have registration under any personal law. 
  • Additionally, an already solemnize marriage can have registration under either the Hindu Marriage Act, 1955, or the Special Marriage Act, 1954. 
  • Similarly, the Hindu Marriage Act applies in cases in which both the husband and the wife are Hindus, Buddhists, Jains or Sikhs, or where they have converted to any of those religions. 
  • Therefore, in the circumstance that either the husband or the wife are not Hindus, Buddhists, Jains, or Sikhs, the marriage is documented under the 1954 Special Marriage Act.

Documents required to apply for Registration

Following documents are required before registering the marriage:

  • Fully filled out the application form, signed by both bridegroom and bride. Form Link: Application Form Please select the form under “Form” 
  • Address proof of the actual living information that should be on the name of the bride or groom (address proof- Voter ID/*Ration Card / Passport, Driving License). 
  • 2 Photographs sized passport. 
  • Identification proof 
  • 2 Pictures of Bride and Groom in marriage attire taken during marriage celebration to demonstrate that they are engaging in a marriage ceremony. 
  • Separate marriage affidavits from husband & wife, in the prescribed format. 
  • Evidence of date of birth of both husband and wife (documents that ideally act as evidence of age 10th level mark sheet with date of birth).
  • Aadhaar Card Marriage Invitation Card Three witnesses to get your marriage approval. 
  • Joint bridal and bridegroom photograph with signature over such photograph. 
  • 2 affidavit that a couple wishes to marry one another happily free from threats will require at a later stage for marriage. 
  • Divorce settlement in the event of a spouse’s Divorce 
  • Death Certificate, widow/widowers (in case of death).

Procedure for Marriage registration

Registration of marriage in Pune can be done offline or online both.

Offline Process of registration

  • You can receive an application form from the respective office on the visit OR you can download it online. Link for application form: Please pick the form under “Form.” 

How to apply for Marriage Registration in Pune

  • Additionally, fill out the application form that has a proper signature by husband and wife. Additionally, send it along with necessary documents and fees to the receiving authority as advised. 
  • After verification, the submitted application will be listed in the registry. 
  • Moreover, applicants will require to come to the premises to complete the registration on a particular date. 
  • Additionally, on the said day, all parties need to be present before the registrar along with a Gazetted Officer who attended their marriage.
  • Additionally, applicants and witnesses should get the sign for endorsement of their marriage on the registry. 
  • Moreover, for already solemnize marriage, the Certificate will be given on the same day.

  • Moreover, get to the next page, select the “Marriage registration and certificate” option under the “Panchayat raj department / Department of Urban Development.” 
  • Similarly, on this page, the application will be present. Fill out the information in the form, upload the documents for scan, and pick the correct details. 
  • Likewise, please hit the “Continue” tab to apply after completing the requirements. 
  • Moreover, the applicant should receive the application in his email after submission of the application and it can be downloaded in PDF format.
  • On the said date, applicants must be present before the registrar along with witnesses. Please submit the obtained printout. 
  • Additionally, applicants and witnesses will need to sign for endorsement of their marriage on the registry. 
  • Moreover, for the already solemnize marriage, the Certificate can be given on the same day.

Things to remember –

  • In marriage registration, the applicants will have to submit the evidence of marriage that has to solemnize somewhere else and now the bride and groom want to legally record it. 
  • At the time of registration, all those who engage in registration will carry originals of ID proof and address proof.

Witnesses of Marriage Registration

  • In order to register the marriage you require three witnesses, the witnesses must present certain documents as evidence. 
  • Witnesses should be an adult, maybe Parents, Family & Friends, and have to be over 21 years old.

Fees of Marriage Registration

The government charges Rs 100 as a registration fee under the Hindu Marriage Act and Rs 150 that charges under the Special Marriage Act.
