Under the Consumer Protection Act, three levels of redressal mechanism have been setup to deliver inexpensive and speedy redressal of consumer disputes.
There are five consumer district forums in Mumbai (including Thane and Navi Mumbai). The jurisdiction is based on territorial limits.
Jurisdiction: Being district forums, the forums can hear cases where the price paid for the service or goods bought is not more than a sum of Rs 20 lakhs.
In order to file a complaint at Consumer Court Mumbai, one needs to file it in a prescribed consumer petition format stating all necessary information. The problems and issues must be stated clearly. Any evidence which is available should be attached with the petition as annexures.
Typically documents like cash receipts, memos, warranty cards etc are treated to be evidence.
A prayer is also attached in the end which states the compensation expected.
All the cases of the consumer redressal forum are uploaded online and one can monitor one's case progress through the CONFONET service available online.
The Consumer Court Mumbai has the power to decide on the case and order compensation. They can also move ex-parte on a case if one party is not represented before the forum.
The fees charged by the Consumer Court Mumbai for filing the cases have to deposited in form of postal order or a demand draft in the name of the President of the respective forum. The fees are given below:
Upto 1 lakh: Rs.100/-
1 lakh to 5 lakhs: Rs.200/-
5 lakhs to 10 lakhs: Rs.400/-
10 lakhs to 20 lakhs - Rs.500/-
In a significant case, the Mumbai consumer forum directed that there is no mandatory time limit within which a claim for car insurance in case of theft can be filed. The time period prescribed is merely directory and not mandatory.
In another case, the Consumer Court Mumbai directed the builder of an apartment to pay compensation delay according the terms prescribed by the contract.
In an insurance case, the forum ruled that insurance companies cannot make changes unilaterally or surreptitiously to disadvantage of the insured. If they do, they will have to pay penalty for the same.
